Terms of Service
These Terms of Service (“Terms”) govern your use of biltongconnect.com.auand your purchases through it (the “Platform”), operated by Henri David Marais (ABN 82 802 589 163) trading as Biltong Connect(“we”, “us”, “our”). By using the Platform or placing an order, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About Biltong Connect
Biltong Connect is an online marketplace for South African–style biltong and related products. Products are prepared and dispatched by independent Partner Butchers. Biltong Connect operates the marketplace, manages the customer experience, processes your payment, and arranges shipping.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of the information you provide, and for activity under your account.
- Keep your login secure, and tell us promptly of any unauthorised use.
3. Products and availability
- Products, descriptions, prices and availability may change without notice.
- Items may be marked sold out at the product or flavour level; we may decline or cancel an order for an item that becomes unavailable.
- We try to display information accurately, but do not warrant that descriptions, images or pricing are error-free. Images may be indicative.
4. Orders
- Placing an order is an offer to purchase. A contract forms when we confirm your payment and accept your order.
- We may refuse or cancel an order (for example, suspected fraud, a pricing error, or unavailability). If we cancel a paid order, we will refund it.
- Each order is fulfilled by a single Partner Butcher.
5. Prices and payment
- Prices are shown in Australian dollars (AUD). Biltong Connect is not currently registered for GST, so GST is not added to your order.
- Payment is processed securely by Stripe. By paying, you authorise the charge for the order total, including any delivery fee shown at checkout.
- We take reasonable steps to prevent pricing errors; the price verified by our server at checkout is the price that applies.
6. Delivery, pickup and fulfilment
- After payment, the Partner Butcher prepares your order and it is dispatched via Australia Post or another carrier we arrange, or made available for pickup where offered.
- Delivery timeframes are estimates, not guarantees. Risk in the goods passes to you on delivery.
- You are responsible for providing a correct, complete delivery address and for making arrangements to receive perishable goods promptly (see section 7).
7. Perishable goods and food safety
- Our products are perishable food. On receipt, inspect your order promptly and store it correctly per any instructions provided.
- Because the goods are perishable, we generally cannot accept change-of-mind returns (see the Refund & Returns Policy).
- Partner Butchers are responsible for preparing products to applicable food-safety standards. If you have allergies or dietary requirements, check product information and contact us before ordering.
8. Cancellations, refunds and returns
Refunds and returns are handled under our Refund & Returns Policy, which forms part of these Terms, and in accordance with the Australian Consumer Law (see section 9).
9. Consumer guarantees (Australian Consumer Law)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage. For failures that do not amount to a major failure, you are entitled to have the problem remedied in a reasonable time, and if this is not done, to a refund. Nothing in these Terms limits your rights under the ACL.
10. Your responsibilities
You agree not to misuse the Platform, including not to: attempt to access others’ accounts or data; interfere with the Platform’s operation or security; scrape or harvest data; or use it for unlawful purposes. We may suspend or close accounts that breach these Terms.
11. Intellectual property
The Platform, and its content and branding, are owned by us or our licensors. You may not copy, reproduce or use them except as needed to use the Platform for its intended purpose.
12. Liability
- Nothing in these Terms excludes rights or guarantees you have under the ACL or other law that cannot be excluded.
- To the extent permitted by law, our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price.
- To the extent permitted by law, we are not liable for indirect or consequential loss.
13. Privacy
We handle personal information in accordance with our Privacy Policy.
14. Disputes and governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. Please contact us first — we aim to resolve issues quickly and fairly.
15. Changes to these Terms
We may update these Terms from time to time. The current version applies to your order and will be posted on the Platform with its effective date.
